Broker's Authorization to Hire Vendor (GAR F828)
This month’s newsletter spotlights an essential tool for agents: the Broker’s Authorization to Hire Vendor form (GAR F828). This form is designed to protect brokers when recommending vendors to clients. It clarifies that providing vendor names is a courtesy only and does not imply any guarantee or endorsement of the vendors’ quality, services, or reports. By signing, clients acknowledge that they’re free to choose any vendor and release the broker from liability regarding vendor performance.
I highly recommend agents use this form whenever arranging repairs before listing a property or when assisting with repairs during the contract period. Note that this form does not cover negotiating repair payments at closing. In those cases, it’s wise to consult an attorney about drafting a promissory note between the seller and contractor. This added step helps secure lien rights for the contractor in case the sale doesn’t close.
